Broadband Labels (Internet de Banda Ancha Etiquetas – en español) are designed to provide clear, easy-to-understand, and accurate information about the cost and performance of high-speed internet services. The labels are modeled after the FDA nutrition labels and are intended to help consumers comparison shop for the internet service plan that will best meet their needs and budget.

Applied Technology Group, Inc. (ATG) will provide Broadband Labels upon request or at the Point of Sale. Current customers can be requested a Broadband Label of your current subscription. If you are a potential customer or someone that is shopping around, it is suggested to have an Internet Survey performed to get accurate results and to see what additional equipment you may need.

Wireless Internet Terms of Contract

This agreement provides only for the right of the User named above to use Applied Technology Group, Inc (ATG). Internet service on the terms and conditions herein contained and in no way confers upon User the right to acquire any equity interest whatsoever. Applied Technology Group, Inc. hereby grants to the User the right to use the Internet service (the “Service”) for the purpose of receiving and transmitting e-mail messages, accessing the world wide web and User agrees to use the Service for the term of this agreement on the terms and conditions herein set forth. Finance charges are billed at 18% Per Annum (1.5% per month) on overdue invoices and monthly services. The terms hereof shall be for the period beginning when service has been established and ending after contract terms have been met and shall be subject to automatic extension as provided herein.

a) Permits, Licenses and Regulations: Customer agrees and understands that it is Customer’s responsibility to abide by all Federal, State and Local regulations pertaining to the installation and operation of the Internet.

b) Liability: Customer agrees and warrants that he will defend, indemnify and hold harmless Company from any liability arising from or in connection with Customer’s use of the Internet. Customer will, upon notice, appear and defend any action brought against company by any party arising from or in connection with Customer’s use of the Internet and Customer will pay all of Company’s costs and legal fees in connection therewith. Company shall have no liability to Customer or other parties for failure of the Internet to operate except insofar as a diminution of Customer’s use charge for the Internet for the period during which such non-functioning shall exist provided the non-functioning condition exists for a period of five (5) consecutive days or more. Recognizing that it is difficult or impossible to ascertain the nature and extent of any damages which may be caused by legal fault on the part of Company, the parties hereto fix the sum of one month’s service as complete and liquidated damages and not as a penalty in the event a court of law or equity determines such damages are the fault of Company. Hold Harmless: Customer agrees to hold Company harmless for any and all damages arising out of Customer’s provision of service or failure to provide service from the Internet in accord with the terms and conditions stated herein. This agreement shall bind the Parties and their assigns, representatives, employees, heirs and successors, and any person or entity demanding performance by any Party in accord with the terms and conditions stated herein. This Agreement cannot be assigned by Customer without the express written approval of Company.

c) Telephone Phone Companies: Customer understands that telephone companies supply varying connection speeds and Company will not be held responsible for customer’s connection speed and line quality. Furthermore, Customer understands that Company has no control or responsibility as to the condition and/or performance of a telephone company.

d) Title: Customer shall have no right, title or interest in the Company’s Internet

e) Use: (1) While using the Internet, Customer shall be responsible for its proper operation in compliance with FCC and federal rules.

f) Failures and Maintenance: Customer is hereby notified and understands that the Internet will not provide service 100% of the time and it will, by its very nature, fail and require maintenance from time to time without notice. Such facts have been taken into consideration by Customer prior to the execution of this agreement, and such failure shall not constitute non-performance or negligence on the part of Company so long as Company expends its best efforts to promptly effect any necessary repairs and maintenance in order to restore service in the event of failure.

g) Termination: Customer will provide Company with a 30 day written notice of service cancellation. If Customer has agreed to a contract term an early cancellation penalty will be charged to the Customer.

h) Default: If Customer refuses to allow Company to perform or through any act causes Company to be unable to perform or in the event that any payment remains unpaid for a period of 10 days after becoming due, or in the event that Customer is delinquent in any payments to the Company or if Customer makes an assignment for the benefit of creditors, becomes insolvent or becomes involuntarily or voluntarily bankrupt, or otherwise in default or in violation of any terms or provisions of this agreement, and fails to correct such default within five (5) days of written notice by Company, Company may declare the entire unpaid balance immediately due and payable with interest thereon at the maximum legal rate. In the event that Customer is in default of any terms or conditions therein, Company may within five days after mailing notice thereof, disconnect Customer’s access to the Internet and otherwise prevent its use until Customer cures the default reimburses Company for its costs of collection, and pays Company a re-connection charge. In the event that payment remains unpaid for period of 45 days after becoming due, Company may disconnect Customer’s access to Internet without notice. Such disconnection shall not cause a reduction in the amounts due under this agreement. In the event suit is brought to enforce any of the terms or provisions hereof, the prevailing party shall be entitled to reasonable attorney’s fees and court costs.

i) Late Charges: In the event any payment due hereunder shall remain unpaid for a period of ten days or more after the due date of such payment, Company shall be entitled to a late charge in an amount of 1.5% per month billed at 18% Per Annum.

j) Notice Provision: Customer promises to notify Company in writing of each and every failure and/or malfunction on the part of Company, by certified mail, return receipt requested, not later than 48 hours after the occurrence of such failure and/or malfunction. Customer also agrees to inform Company of all changes of address, telephone, ownership, contact personnel, location of computer, or company structure within 10 days after said change.

k) Paragraph Headings: The headings of the paragraphs herein are contained for reference and convenience only and should not be interpreted in connection with the actual provisions hereof.

l) Additional Charges: Company will render additional billings for the following reasons: (1) Modifications, assignments, additions and deletions. (2) Investigating/repairing communications problems that are not created by a defect in the Company’s equipment including but not limited to failures of Customer’s equipment. (3) Service requests during hours other than Mon-Fri. 8:00 A.M. to 5:00 P.M. excluding holidays.

m) Rate Adjustment: The rates in this agreement may be adjusted once each year due to cost increases beyond the control of Company. Should this occur, Company must give Customer 30 days written notice of its intention to adjust said rates. This agreement may also be adjusted once each year to compensate for corresponding increases in the consumer price index without notice to Customer.

n) Interruption of Service: In the event service has to be interrupted for non-pay, a $25.00 re-connection fee plus all accumulated charges and two (2) months of service will be required prior to restoration of service.

Wireless Internet Rental Equipment

Applied Technology Group, Inc. (ATG) provides all necessary wireless radio equipment to customers on a rental basis, ensuring that the technology stays up-to-date and professionally maintained. This rental model allows ATG to monitor and service the equipment as needed, guaranteeing optimal performance without requiring a significant upfront investment from the customer. In addition to the wireless radio, customers also have the option to rent a router if they do not already have one that meets the system requirements. However, ATG does not allow customers to purchase any of the rental equipment, as retaining ownership ensures that ATG can replace or upgrade devices whenever necessary to maintain high service standards.

Wireless Internet Latency

Applied Technology Group, Inc. (ATG) is dedicated to delivering the lowest possible latency in its wireless internet services, with a goal of achieving latency as low as 1 millisecond (ms). However, several factors can impact this performance. Wireless internet requires clean frequencies, meaning there must be minimal interference from other devices or networks. Additionally, achieving optimal performance relies on a perfect line of sight between equipment, as obstacles such as buildings, trees, or weather conditions can disrupt the signal. All equipment involved in the transmission, from antennas to routers, must also be in peak working condition to ensure minimal delay.

Latency refers to the time it takes for data to travel from one point to another, usually measured in milliseconds. In the context of internet services, it specifically measures the delay between sending a request (such as loading a webpage) and receiving a response. Low latency is crucial for applications requiring real-time communication, such as online gaming, video conferencing, and financial transactions. ATG strives to minimize this delay, but the inherent challenges of wireless technology can sometimes prevent reaching the ideal 1ms latency.

Several factors can contribute to high latency, some of which are outside of ATG’s control. Interference from other wireless networks, electronic devices, or environmental obstructions like buildings and trees can disrupt signal clarity, leading to delays in data transmission. Weather conditions such as heavy rain or snow can also impair signal quality. Additionally, if the consumer’s devices—such as routers, modems, or computers—are outdated, malfunctioning, or improperly configured, they can cause significant latency. For example, slow processing speeds, overloaded networks, or poor Wi-Fi connectivity within the home can all contribute to increased delay, even if ATG’s external network is operating optimally. It’s important for customers to ensure their equipment is in good condition and positioned for optimal performance to minimize latency issues.

Wireless Internet Data Usage

Applied Technology Group, Inc. (ATG) does not impose any limits on internet data usage, ensuring customers can enjoy unlimited access without concerns of data caps or throttling. However, there are instances where data usage could appear limited due to factors related to the wireless internet equipment. For example, signal issues may arise if the antenna is blocked, has shifted position, or is affected by weather conditions, all of which can reduce performance. Additionally, the radio or router may experience glitches or require maintenance, leading to disruptions. Consumers may also experience slower speeds if they are maxing out the capacity of their internet connection, particularly when multiple devices are in use or bandwidth-heavy applications are running. Addressing these issues can help ensure optimal data performance.

Wireless Internet Discounts & Bundles

Currently at this time, Applied Technology Group, Inc. (ATG) does not offer discounts for internet or bundle services together.

Wireless Internet Early Termination Fees

Customers have the option to Terminate their contracts before their end of term. Customers must provide Applied Technology Group, Inc. (ATG) with a 30 day written notice of service cancellation. ATG will then schedule a time before the end of the month to collect rental equipment.

This fee is 50% of the non-completed contract agreement.

(Example: 1 Year Contract at $59.99, $59.99 x 6 months = $359.94)

Wireless Internet Network Management

Applied Technology Group, Inc. (ATG) actively monitors all network rental equipment, including wireless radios and any other devices that connect ATG’s towers back to the main office, ensuring efficient and reliable service. This proactive approach allows ATG to address potential issues quickly, maintaining high performance and minimizing disruptions. While ATG manages the network through its own routers, performing daily maintenance and updates to keep systems running smoothly, it does not monitor or manage customers’ personal routers or other personal equipment. This clear distinction keeps customers’ personal devices private, while allowing ATG to focus on maintaining robust, well-managed networks with high-quality connectivity.

Wireless Internet Privacy Policy

Applied Technology Group, Inc. (ATG) is committed to respecting customer privacy while maintaining a reliable network. To support optimal service, ATG monitors and collects internet traffic data for routing and troubleshooting purposes only. This data collection allows ATG to effectively diagnose and resolve any latency, traffic congestion, or routing issues that may arise, ensuring customers receive high-quality service. Importantly, ATG retains this data for a limited period of just 7 days, after which it is automatically deleted, providing a balance between effective network management and customer privacy. This policy ensures that data is used solely for network performance enhancements and troubleshooting, maintaining transparency and confidentiality for ATG’s customers.

Copyright Infringement

Applied Technology Group, Inc. (ATG) respects the intellectual property rights of others. Accordingly, you may not use ATG’s network, systems or servers to transmit, upload, download, post or submit any content, images or data in any manner that constitutes an infringement of third party intellectual property rights, including under US copyright law.

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides that owners of copyrighted works who believe that their rights under U.S. copyright law have been infringed may report alleged infringements to service providers like ATG when content is stored or hosted on ATG equipment. Separately, under ATG’s Copyright Alert Program, ATG voluntarily accepts and processes allegations of infringement over peer-to-peer (P2P) technologies so long as the content provider, or its agent, submitting such allegation abides by ATG’s business rules. ATG provides an online form that copyright holders should use to send notifications related to alleged copyright infringement by its customers.

The ATG Copyright Alert Program informs you about possible copyright infringement on your Internet service account (like unlawful video or audio file sharing) so that you, as the account owner, can take steps to prevent any future possible infringement using your Internet service account. Sharing copyrighted material using P2P technologies without the permission of the copyright owner or its authorized representative is in many instances unlawful and can subject infringers to potential civil and criminal liability.
